Water and Power Law Group PC provides legal services designed to achieve water management which fosters water supply reliability and sustains aquatic ecosystems. 

Our nation faces growing and even acute shortages in water supplies.  Fisheries and other key elements of our aquatic ecosystems are declining. Groundwater aquifers are increasingly slipping into overdraft. These conflicts will best be resolved through management arrangements that integrate water supply and environmental quality, and that comply with applicable laws systematically rather than on piecemeal basis.

We have a track record of achieving effective and durable solutions for conflicts involving:

  • Surface water rights and instream flow for fisheries;
  • Groundwater management to avoid overdraft and maintain water quality; and
  • Environmental compliance in water uses.

Groundwater

Water and Power Law Group groundwater work includes both improving groundwater supply management and brownfield remediation to protect water quality. In terms of groundwater supply management, WPLG advises public agencies, private land trusts and farmers to help prevent the over-pumping and depletion of groundwater. For instance, WPLG currently serves as co-counsel in litigation on behalf of a county farm bureau challenging a proposed residential project that threatens critical groundwater irrigation supplies for local orchards. In terms of protecting groundwater quality, WPLG currently represents several owners of brownfields engaged in the development and implementation of agency-approved groundwater treatment and monitoring plans.
