Seneca Pumped Storage Project Settlement Agreement

On November 26, Seneca Nation of Indians and FirstEnergy reached a Settlement Agreement resolving competition for the new license for the Seneca Pumped Storage Project on the Allegheny River in Pennsylvania.  The parties filed notice before the Federal Energy Regulatory Commission, which is overseeing the relicensing proceeding under the Federal Power Act.  Among other things, the agreement resolves disputes related to the project’s use of the Seneca Nation’s lands and waters, held under the 1794 Treaty of Canandaigua.
